Supes order accessory structure removed

The Lafayette County Board of Supervisors voted to order that an accessory structure be removed from property located on County Road 427.
The property is owned by Willard Denham and occupied by his daughter Connie Denham and Dean Edwards. All three attended the meeting Monday morning at the Lafayette County Chancery Building.
Last year, the Board ordered that the property be cleaned up due to tires, several inoperable cars and other debris being on the property.
Director of Developmental Services Joel Hollowell told the Board Monday that the Denhams and Edwards have done a good job cleaning up the property; however, part of the cleaning process included building an additional accessory structure onto the back of an existing shed to store the tired and other materials.
Hollowell said the issue with the accessory structure is that it was built less than 5 feet from the property line. County code requires at least a 10-foot setback for accessory structures. He recommended to the Board that the structure be removed. If it is not removed by May 19, Denham faces a fine of $100 a day for each day the structure remains.
The Denhams said that the property lines are incorrect and that they are 10 feet away. Hollowell said a private surveyor, hired by the Denhams, showed the property line as being correct and that the structure was about 4 feet from the property line.
The Denhams could not speak during the meeting since it was not a public hearing. Edwards and Connie attempted to explain to the Board that a new survey showed a conflict; however, since the meeting was not a public hearing, they could not speak before the board. Edwards was asked to leave the meeting by an attending Lafayette County deputy.
The board said Denham could apply for a variance from the setback and instructed them and Edwards to speak to Hollowell on that process.
The vote to order the accessory structure to be removed was 4 to 1, with Supervisor Tim Gordon dissenting.
Also on Monday, the Board set two public hearings for May 19 to determine if unclean conditions at 13 County Road 226 and 536 Highway 310 in Como are a menace to public health, safety and welfare.
