Day two of the murder trial against Sheldon “Timothy” Herrington Jr. focused on creating a timeline of what happened to Jimmie “Jay” Lee before he disappeared on July 8, 2022.
Herrington, 24, was arrested on July 22, 2022, and charged with Lee’s murder. He was indicted on a capital murder charge and has been out on a $250,000 bond since December 2022.
Lee’s body has not been recovered.
The day started with testimony from Kizziah Carter, who told jurors that he had left his job at Winchester at 7:30 a.m. on July 8, 2022, and was driving down Molly Barr Road when he saw Herrington jogging down the road.
Carter said he knew Herrington through his girlfriend and other friends but wouldn’t consider them “friends.” However, he did recognize Herrington and honked.
“He waved for me to pull over,” Carter said.
Carter said Herrington asked for a ride home to Lafayette Place apartments off Jackson Avenue West.
Later, jurors would hear how Lee’s vehicle was found later that day at the Molly Barr Trials apartments. The complex had the vehicle towed since it did not belong to a resident.
Much of the day was spent hearing testimony from University Police Department Capt. Jane Mahan.
Mahan testified that officers were called out to conduct a welfare check on Lee at his Campus Walk apartment on July 8 after Lee’s mother had contacted them because she was concerned after not hearing from him. The apartment appeared lived-in with no bags packed.
She said she spoke to Lee’s friend, Khalid Fears, who also called UPD. He told them he was on Facetime with Lee when Lee was leaving his apartment. Fears testified Tuesday that Lee told him he was going to see someone he had been with a couple of hours earlier.
Search warrants were issued for Herrington’s phone and social media sites.
Oxford investigator Mark Hodges testified after Mahan in the afternoon. Video and still photographs were shown to the jury showing Lee’s car driving east on Jackson Avenue and then on Molly Barr Road around 7 a.m.
Footage from Molly Barr Trials apartments also showed Herrington jogging out of the apartment complex, Hodges testified.
The trial will continue at 9 a.m. on Thursday with Hodges back on the witness stand.
